(1) The Government of Nepal will publish a notice in the Nepal Gazette and establish a three-member Information Technology Tribunal consisting of a law member, an information technology member and a commercial member from among the persons who have attained the qualifications according to section 61 to initiate and resolve the offenses mentioned in paragraph-9.
(2) The Law Member shall be the Chairman of the Tribunal.
(3) The Tribunal shall exercise its jurisdiction as prescribed (4) A person who is not satisfied with the decision or order made by the Tribunal may appeal to the Appellate Tribunal within thirty-five days from the date of such order or decision.
(5) Notwithstanding anything written elsewhere in this section, until the tribunal is established as per sub-section (1), the district court designated by the Government of Nepal by publishing a notice in the Nepal Gazette shall have the jurisdiction to initiate proceedings and dispose of the offenses as mentioned in paragraph-9.
